Although the twit who handles PR for Premaitha (NIPT) has again contrived to confuse the issue with some garbled press releases this morning there is actually some good news. Fire the idiot PR man and investors could get excited as they discover what is really going on.

It’s good news also that multiple claims against different parties will be heard together as it will undoubtedly concentrate the judges mind on Illumina’s modus operandi to bully competitors.
Imagine Illumina having to explain away to their shareholders that they have had their arses kicked on FOUR cases in one day!
This will maybe focus minds on reputational issues over in Illumina’s legal and PR departments.

Not so good is news that further litigation against a NIPT customer by Illumina today. This isn’t likely to help NIPT to get potential customers to commit so there’ll be uncertainty for 1yr+.

No issues on validity would have been discussed at a CMC. What’s good about the case being deferred for a year! The good news is that it is consolidated with Ariosa and I expect Premaitha saw that as a better idea than steaming ahead without them. I was rather hoping that it would be consolidated AND heard in Oct 2016. More time means that Ariosa are going to get their expert evidence correct and probably more likely to win. But its a long wait…The SP is not going to lift off I feel. To say otherwise is a little bit rampy.

In the politics of the CMC, it’s probable that Premaitha argued for consolidation and therefore delay because that would help the Court to accept an extremely late application for permission to file an anti-competition counterclaim. which is hugely out of time. All this will only be good news if that application is granted.
