Disclosure: I have no positions in any stocks mentioned, and no plans to initiate any positions within the next 72 hours. I wrote this article myself, and it expresses my own opinions. I am not receiving compensation for it (other than from ShareProphets). I have no business relationship with any company whose stock is mentioned in this article.
In this bearcast I start with the issue of the abject failure of regulation and my support for Class Actions - let market forces deal with the fraudsters where the State has failed. Then onto oil and why M&A action will not save the juniors on the AIM casino. Finally to what happens as a PLC goes into death throes, Quindell, its share price. the motivation of whistleblowers and more.

Thanks for another great informative BearCast!
Further to your Quindell and Class Action remarks, can I draw your attention to this comment posted in response to Peter Campell’s article for THE DAILY MAIL, published 19th December :-
adi wallasey, cognac, France,
“What a pathetic article. INUNDATED? Do you know where Birkenhead is located on the map? Go check their office. Ambulance chasers. No member of QPPSAG has the slightest intention of going anywhere near this Company. Oh, and by the way QPPSAG own 10% of this Great British Company employing 4000 people, all paying taxes, many of them working in QUIDELL’s Liverpool office. Go check, or is that too much work for you?”

Obviously the irony is lost on ‘adi wallasey’, that the bulk of Quindell’s businesses are nothing more than Ambulance Chasers! Kettle pot black, me thinks!
In fact, strip away the accident claims and associate companies like Mobile Doctors, discard the dozen or so of worthless junk acquisitions, eg Brand Extensions, LearnED, TMC (Southern) Limited etc etc etc and your virtually only left with…..
Ingenie……. glorified insurance broker…….. and that Jewel in the Crown…….Himax…… glorified phone app…… and to anybody that has any doubts to what a piece of crap it is, look at this :-

Wonder what bloody genius thought that was worth $240 million?

The biggest fraud on AIM is not Quindell its the FCA. I get phone calls from brokers punting shares, I suspect they are a boiler room but then they tell me they are FCA registered so I sigh with relief and welcome them to my bank account details and pin number, well I dont but its clear from the Quindell debacle that many people are gullible. The FCA should be closed down or get rid of the bonus building clowns that are paid big money from my taxes and just keep a skeleton staff of lowly paid admin workers who can be more successful than the present management at least there would be less kidding on that they have big teeth. We have government warnings on cigs that you can be dead after smoking and yet anyone is allowed to do it so all we need to do is put a warning on the letterhead of all AIM listed companies/NEDs/NOMADs etc ‘ this person or company may be fraudulent, in many cases your investment will eventually be worth nilp’, this should be in large type at the top of the letterhead not the silly little warning sentence used now about investments may go down, obviously some people do not understand this. As we know with smoking some people dont mind being dead they would rather have a fag so its likely people would still buy the Quindells of AIM but at least it would annoy the purveyors of this shit, a photo of a steaming dog turd could be added to reinforce the message.

It’s shameful, imo, that shareholders need to bring together a class action and, I suppose, find a legal “angle” to convince a judge to hand down a judgement that becomes either a precedent or a deterent for the future; How can the supposedly regulatory authorities justify their existence? Or governments continue to support continued “light touch regulation”? I hope the lawyers taking these cases on are clever and do nail these company directors but also set up sound precedents for others to follow. The government and the authorities will do nothing, they’re “all in it together”. Only the judges can bring change.
