One of the more surprising tweets I received last week was from a lady in the grim north called Kate (@modelsforkate) who had for some time been a self-confessed Quindell (QPP) shareholder and did not like what I was writing so took nearly all her clothes off in protest and send out a tweet inviting me to “kiss her ass”. Whatever. It has subsequently emerged that Kate’s enthusiasm for Quenron might be influenced by the fact that she earns fat fees sending clients to its ambulance chasing whiplash and industrial deafness centres. But let’s still give Kate a platform. As such I bring you her selfie and invite you to post suitable captions below. Deadline midnight tonight?

Surprisingly with TW on this one. Kate, what did you think would happen when you sent this on the most public of forums? Also, changing your profile to private this morning doesn’t suddenly change Tom’s right to then post it again (think retweets etc).
He’s an arse (excuse the pun) however you literally gave him the ammunition for this. You would be happy for people to retweet images of your basically naked body for fame & followers, but then hold objections when people dare to ridicule you? Kate – sorry if this has distressed you but I’m sure many here find it very strange and more than a little disingenuous that you feel you had the right to send this as an accompaniment to unsolicited verbal abuse aimed at someone you’ve presumably never met and don’t know, and then claim a lack of propriety on the part of the recipient when he shares it (I don’t “tweet” or whatever the term is myself but it’s the same thing – you sent it)! Let me ask you directly – what do you think gave you the right to send this and verbally abuse him in the first place? Incidentally, it’s very tame and I’m sure those who’ve posted see it just as a bit of fun (I did, but if my lame ‘entry’ is genuinely causing distress then I’d rather it be removed).

Tom, have you ever tried to be the bigger person? Do you realise how re-posting this image as a caption competition makes you, and the wider ShareProphets editorial process (presumably there is one), look? I imagine you don’t really care and have justified your actions to yourself in your usual contorted manner however, regardless of your previous interactions with this person on Twitter, this really is exceedingly poor and uncalled for.
You may also wish to investigate the specific law on cases such as this; whereby you may believe that you are within your right to copy and post the image due to it having been tweeted to you – perhaps I may refer you to AFP/Washington Post v Daniel Morel for a steer, particularly: “Construing the Twitter TOS to provide an unrestrained, third-party license to remove content from Twitter and commercially license that content would be a gross expansion of the terms of the Twitter TOS.” You may believe you can fall back on the Enterprise & Regulatory Reform Act, aka Instagram Act, however as this is clearly not an “orphan photo” then any such reasoning is untenable.
To put it simply, the author of the photo has the exclusive right to use, reproduce and display a photo; tweeting the photo to you in the first instance is a form of reproduction which is one of the prerogatives of the author and explicit permission is required for any further posting of said content. Hence you are on even dodgier ground with Kate having specifically requested you to take this image down as you are seen to be acting in a wilful manner, especially so given your typically pejorative rebuttals in the comments.
I’d urge caution in terms of some of the other comments too – as you should be aware, legally you are on very dodgy ground if you “moderate” posts that appear to be defamatory in nature, i.e. the accusations of someone being a slapper / drug user, as you are assuming responsibility for the material that appears and are likely to be liable for the content.
You really aren’t doing yourself any favours on this.

Twitter is a public medium. A world-wide public medium. In no way is it a private mode of communication. A comparison would be broadcasting on the radio. Or putting up a billboard on the roadside. Maybe nobody is paying attention. Or maybe everybody is.
In any case, by adding the hashtag QPP, @ModelsForKate intended to have the Tweet viewed by thousands of people, as QPP is a very popular search term.
Second, we used Twitter’s Embed Tweet tool. Go to Twitter.com and look at any tweet. Go ahead. We’ll wait.
Okay, on that Tweet, see the three little dots on the right hand side. Click it and you’ll see ‘Embed this Tweet.’ You can embed any tweet that your heart desires. The Queen’s. Johnny Rotten’s. Wimpy Burger’s. It doesn’t matter who – this is part of the Twitter service. It’s not some weird, hacking, black-hat operation – it’s a main feature of Twitter.
So, the way this went down, @ModelsForKate had someone take a picture of her, downloaded that picture to her computer, fired up a browser, went to Twitter.com, attached the photo, and typed the words ‘@TomWinnifrith. Then Kate said we were not allowed to do that. Or rather ‘Take that down now! You have no right whatsoever to post my pictures have this deleted as you have no permission to use it x’.
Of course we do. You have the right to use it too. You have the right to embed any tweet that is embed-able.
As for the rest, it’s almost too dull for words:

This is a misunderstanding about what happens under the EU’s ‘Right to be Forgotten’ directive. It may be possible to have Google remove a link to this page when one searches for @ModelsForKate – and we certainly don’t care if that happens – but this page would remain. Only the Google search is edited.
However, it has been made clear that the right to be forgotten system does not include work that you yourself have posted about yourself. To sum it all up: if you want to insult someone with some expectation of privacy, send a letter or make a phone call; if you deliberately want to the entire world to see you insult somebody, just do what @ModelsForKate did.

I would imagine as a old business partner of Mr Terry and a committed follower of the Quindell success story, Mr Stretton Knowles holds considerably more than the 3.20% of equity in the company than on the 31st May 2011?
Perhaps, you can confirm this is indeed the case or further update us to his actual shareholding?
