BOD have stated 5 more contracts before end of March 16.
The £5M deal with US life sciences giant Thermo Fisher is very significant here (could be gearing up to launch a take-over) and shows a massive vote of confidence in Premaitha.
TF and those signing new contracts are clearly not concerned with the litigation, Premaitha have a strong defence and will walk it …
The basis of the Illumina writ against Premaitha is that they are claiming patent ownership of a ‘naturally occurring substance’. The courts in USA have thrown out the claim twice recently (latest one below) and the same will be repeated here.
Premaitha’s defence is that the IONA test is a ‘method’ which is different to Illumina’s hence no infringement.

U.S. court rejects Sequenom bid to restore prenatal DNA test patent
A U.S. appeals court refused on Wednesday to reconsider its decision invalidating a Sequenom Inc prenatal DNA test patent, a decision that could put in doubt the validity of a wide range of medical and biotechnology patents.
The U.S. Court of Appeals for the Federal Circuit in Washington said in June the patent was not eligible for legal protection because it fell under the U.S. Supreme Court’s rule against patenting natural phenomena. That decision upheld a ruling by a lower federal court in California that cleared Roche Holding AG unit Ariosa Diagnostics of infringement.

What ever ……………the shares will still crater before the court case …………. then you can buy them cheap . If its just a method then anyone can do it and then I cant see NIPT ever making a profit from doing it .
